Acceptable Use Policy

Brandkept is an organizational and tracking tool. It does not provide legal, tax, financial, or compliance advice. Nothing in Brandkept constitutes legal advice. Always consult qualified professionals for your specific situation.

1. Overview

This Acceptable Use Policy ("AUP") governs how you may use the Brandkept platform. It applies to all account holders, users, and anyone who accesses any part of brandkept.com.

Brandkept exists to help parents and legal guardians of minor content creators stay organized, manage records, and understand their obligations under state Coogan laws. The platform was built around a single principle: protecting child creators and their families. This AUP reflects that mission.

By creating an account or using Brandkept in any way, you agree to this AUP in addition to our Terms of Service and Privacy Policy. Violations may result in account suspension or termination.

2. Permitted Uses

Brandkept is designed for, and you may only use it for, lawful and appropriate purposes, including:

  • Compliance management for your own children — managing income tracking, Coogan trust set-aside calculations, and compliance records for children who are your legal dependents or wards
  • Income organization — recording, categorizing, and organizing creator income from platforms such as YouTube, TikTok, Instagram, and Twitch, for children under your legal guardianship
  • Coogan law calculations — using Brandkept's calculator to estimate trust set-aside obligations based on publicly available state law data (not as legal advice — always verify with a qualified attorney)
  • Brand deal record-keeping — tracking brand partnerships, parental consent records, and deal status for deals you personally negotiated and entered into on your child's behalf
  • Tax document organization — uploading and organizing 1099s, receipts, and other tax documents related to your child's creator income
  • Professional access — inviting a licensed CPA, attorney, or financial advisor to view your data through Brandkept's designated professional partner features

3. Prohibited Uses

You may not use Brandkept to:

Child Safety

  • Manage data for any child who is not your legal dependent or ward
  • Misrepresent any child's age, state of residence, or income figures
  • Use the platform in any way that could harm, exploit, or endanger a minor
  • Circumvent COPPA protections or state child influencer protection laws
  • Upload or generate sexually explicit content involving anyone, particularly minors

Account & Access

  • Share your account credentials with anyone outside of authorized professional partners invited through the platform
  • Create multiple accounts to circumvent feature limits or subscription restrictions
  • Impersonate another person, parent, or guardian
  • Access any account you are not authorized to use

Technical Abuse

  • Reverse engineer, decompile, or disassemble any part of the service
  • Scrape, harvest, or extract data from Brandkept using automated tools
  • Attempt to access, tamper with, or test security systems without written authorization
  • Upload malware, exploits, ransomware, or any harmful code
  • Interfere with or disrupt the integrity, availability, or performance of the service
  • Use the service to conduct denial-of-service attacks or similar network abuse

Legal & Compliance

  • Violate any applicable federal law, including the Children's Online Privacy Protection Act (COPPA), the Child Labor Laws (FLSA), or the Federal Trade Commission Act
  • Violate any applicable state Coogan law or child influencer protection statute
  • Use Brandkept information as a substitute for actual legal compliance without professional verification
  • Resell, sublicense, or white-label any part of the service without written authorization from Brandkept
  • Use the service to facilitate the unauthorized practice of law or accounting

4. Account Security

Because Brandkept stores sensitive financial data and information about minors, you have elevated security responsibilities as an account holder.

You are responsible for:

  • Choosing a strong, unique password and keeping it confidential
  • Enabling multi-factor authentication (MFA), which Brandkept offers and strongly recommends for all accounts
  • Logging out when using shared or public devices
  • Maintaining the security of any device used to access Brandkept
  • Not saving your credentials in unsecured locations
  • All activity that occurs under your account, whether authorized by you or not

If you believe your account has been compromised, you must notify us immediately at security@brandkept.com. We will work with you to secure the account. Delay in reporting a suspected compromise may affect your ability to recover data or limit liability for unauthorized actions.

Brandkept will never ask for your password by email, phone, or chat. If you receive a request purporting to be from Brandkept that asks for your password, do not respond — report it immediately to security@brandkept.com.

5. Content Guidelines

When uploading documents, files, or any other content to Brandkept, you represent and warrant that:

  • You own the content or have been expressly authorized by the owner to upload it
  • The content does not infringe the intellectual property rights of any third party
  • The content is related to your child's creator activity and is being uploaded for a legitimate record-keeping purpose
  • The content does not contain malware, exploits, or code designed to harm Brandkept or other users
  • The content does not include any sexually explicit material involving minors or anyone else
  • Tax documents, contracts, and financial records uploaded represent actual transactions and are not falsified

Brandkept does not review uploaded documents for accuracy. You are solely responsible for the accuracy of all data and documents you upload. We reserve the right to remove content that violates this AUP without prior notice.

6. Enforcement

Brandkept reserves the right to investigate and take action in response to any suspected violation of this AUP. Actions we may take include, but are not limited to:

  • Issuing a warning and requesting remediation
  • Temporarily suspending access to your account
  • Permanently terminating your account
  • Removing or withholding content that violates this policy
  • Reporting violations to law enforcement or regulatory agencies where required by law or where we determine it appropriate to protect minors
  • Pursuing civil or criminal remedies to the extent permitted by law

We may act without prior notice where we reasonably believe that immediate action is necessary to protect the security of the platform, the privacy of children's data, or the safety of any individual.

Our failure to enforce any provision of this AUP in a particular instance does not constitute a waiver of our right to enforce it in other instances. Enforcement decisions are made at our sole discretion.

7. Reporting Violations

If you become aware of any conduct that violates this Acceptable Use Policy — including suspected abuse of children's data, unauthorized account access, or misuse of the platform — please report it promptly.

We take all reports seriously and will investigate promptly. For reports involving the safety of a minor, we will escalate appropriately. If you believe a child is in immediate danger, contact law enforcement directly — do not wait for our response.

We will not retaliate against anyone who makes a good-faith report of a violation, even if our investigation concludes that no violation occurred.
